 A ruling issued under Regulation E & Electronic Funds Transfer Act will take effect July 1, 2010 for new clients and August 15, 2010 for existing clients.

 The regulation states that a fee for paying an overdraft for an ATM or one-time POS transaction cannot be charged unless:

1. Proper notice is provided to the client describing the bank’s overdraft service;
2. The client is given a reasonable opportunity to consent (opt-in);
3. The client’s affirmative consent is obtained; and
4. Confirmation is provided to the client, including notice of the right to revoke.

 Franklin Community Bank has not engaged in the authorization of overdrafts on ATM or one-time POS transactions and will continue to conduct business in that manner at this time. Therefore, we feel this new ruling will have no impact to our clients.

 The Worker, Homeownership, and Business Assistance Act of 2009 has established a tax credit of up to $6,500 for qualified move-up/repeat home buyers (existing home owners) purchasing a principal residence after November 6, 2009 and on or before April 30, 2010 (or purchased by June 30, 2010 with a binding sales contract signed by April 30, 2010).

The Worker, Homeownership, and Business Assistance Act of 2009 extended the tax credit of up to $8,000 for qualified first-time home buyers purchasing a principal residence. The tax credit now applies to sales occurring on or after January 1, 2009 and on or before April 30, 2010. However, in cases where a binding sales contract is signed by April 30, 2010, a home purchase completed by June 30, 2010 will qualify.
